When can I start to receive interim payments?

If you have developed CRPS, fibromyalgia, or chronic pain following an accident that was not your fault, you may be entitled to compensation. The claims process can be lengthy, which is why many people look to receive an interim payment while their case is ongoing.

Interim payments can be made at any stage of a CRPS, fibromyalgia or chronic pain claim once liability has been addressed, but it’s not as straightforward as simply asking for money. There isn’t an official timeline for requesting them. In practice, interim payments are usually prompted by specific financial hardship or the need for funding treatment to manage your condition.

Defendants are naturally cautious when it comes to paying out interim sums. They will not agree to release more than what they believe the claim is likely worth on their assessment. This is to prevent any over payments in case their evidence is accepted.

For example, if the Claimant’s evidence values the claim at £100,000, but the Defendant’s evidence values the claim at only £15,000, any interim payment is likely to be limited to £15,000. This is to prevent the scenario where someone receives £25,000, but the eventual settlement or judgment values the claim at no more than £15,0000. In such a situation, the excess £10,000 would have to be repaid.

 As a result, interim payments are more likely to be agreed once medical records and reports are obtained, as these help quantify the claim, and there is a clearer picture of potential settlement values.

It is also often in the Defendant’s interests to approve interim payments if the funds are being requested for treatment that could improve your condition, potentially reducing the overall claim, or for any other purpose that mitigates loss.
