Complex CRPS and Functional Neurological Disorder case

This case study was written thanks to the expertise of our team, including Alex Cohen, Philip Cohen, and Steven Akerman, leading experts in compensation claims for chronic pain and serious injury.

Our client was a student at secondary school when he was involved in an accident that had far-reaching consequences for his physical and mental health. Following an incident in the school grounds, he initially experienced pain in his right forearm, which intensified over time and led to a diagnosis of Complex Regional Pain Syndrome (CRPS). This diagnosis unfortunately marked the beginning of a long journey of medical treatment and additional health complications.

Our client underwent various treatments, including physiotherapy, trigger point injections, and medication. Unfortunately, these interventions did not alleviate his pain and over time, his condition became even more complex. He began experiencing dissociative episodes that mimicked epileptic attacks but were likely psychological in nature rather than neurological. He was further diagnosed with FND (Functional Neurological Disorder), a condition that disrupts the nervous system’s functioning, adding to his challenges in coping with daily life. He also developed persistent abdominal symptoms, which have added to his discomfort and impacted his quality of life.

Despite our client’s debilitating symptoms, the Defence denied liability all the way through disputing both the extent of our client’s physical deterioration and the range of issues that had emerged since the accident, arguing that the scope of the case was excessive.

Our client successfully completed his college degree. However, the long-term effects of his injuries mean that our client faces challenges. Our client was able to work full time in his chosen profession without any loss of earnings, although there was some uncertainty as to the future given our client’s relatively young age.

The combination of CRPS, FND, and abdominal symptoms created a unique and highly complex medical profile that required specialised legal representation. As experts in this area, Brian Barr were able to successfully represent this client. Despite their hardline stance at first, and due to the efforts and evidence brought forward by Brian Barr, the defence then came to us with a substantial offer.

Recognising the potential risks and uncertainties surrounding this case, given the complete denial of liability, and guided by Brian Barr Solicitors, our client chose to settle the case for £45,000. This settlement acknowledges the significant impact the accident has had on his life and will provide some financial support to assist with his ongoing needs.

This case highlights the complexity and severity of cases involving CRPS and other neurological disorders and ‘invisible illnesses’ that may emerge following an accident. At Brian Barr Solicitors, we understand the intricate medical and legal challenges that accompany such cases and are committed to advocating for fair compensation for our clients, no matter how complex the journey.
