What is Clinical Negligence?

Doctors and healthcare professionals have a duty of care to their patients. If the standard of care falls below what is considered to be the accepted standard of medical care by other professionals of their specialism, the duty of care has been breached. If as a result of this breach of duty, the patient suffers injury or loss, whether by misdiagnosis, delay in diagnosis or mistreatment, clinical negligence has occurred.

What are the effects of clinical negligence?

The effects of clinical negligence are varied, with each case having its own set of unique circumstances. In some cases, the damage done is relatively minor and is quickly resolved whereas in more severe circumstances, the patient can be left with life-altering injuries.

What are Birth Injury claims?

Most births are without complication but when things do go wrong, the effects can be devastating for mother or child. As with general clinical negligence claims, if the doctors or healthcare professionals fell below the standard of care and that caused the injury or loss to the mother and/or child, a claim for compensation can be made.

What are the effects of Birth Injuries?

Injuries to the mother can include infections, loss of functions, or the development of a chronic pain condition. Injuries to the child can include developmental delays or development of disabilities which significantly affect the child’s quality of life. Injuries to the child can be caused by oxygen deprivation during delivery.
